International Child Custody Law

We live in different countries – how can we co-parent?

We have an international team of lawyers here at DuBois Cary Law Group. Monica Kaup Cary is the daughter of immigrants from southern India. As a child, Monica regularly traveled overseas to see her family. Monica advises clients on optimal residential access schedules for parents who live on different continents. These plans often include specific provisions regarding online access, including Skype and FaceTime, or other internet tools. Monica is a past presenter to the King County Family Law Bar Association on the issue of International Parenting Plans and Virtual Visitation.

Lucia Ramirez Levias has family in Peru. With this invaluable personal experience, our lawyers are committed to coming up with a parenting plan in which the child has significant exposure to the native culture and language of the parent who is from another country.

When parents share custody but do not live in the same country, the visitation and parenting plan can be very complex. A parent visiting from another country may be granted more liberal visitation than one living nearby. In some cases, parents may communicate with their children through virtual visitation.

International Child Abduction

Child relocation is governed by the laws of the state where the child resides. If a parent relocates a child to a foreign country without a custody arrangement in place, it could be considered a case of international child abduction. These cases are governed by the Hague Convention, an international law concerning the safety and well-being of children.
